Terms and Conditions

1. Acceptance of Terms

By accessing, downloading, installing, or using Gym Clock (the "Application" or "Service"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Application.

These Terms constitute a legally binding agreement between you and Gym Clock Inc. If you are using the Application on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case "you" will refer to such entity.

Offline use. You may use many App features without an account. These Terms still apply to your use of the App.

Account creation. Creating a Gym Clock Account is optional. If you create an account, you agree to these Terms and the additional account terms in Section 4 and Section 7. Account signup screens link to these Terms and our Privacy Policy; by creating an account you confirm you have read and agree to both.

2. Health & Safety Disclaimer

Gym Clock is designed to assist with workout routines and fitness tracking. However, we are not medical professionals, and this application does not provide medical advice, diagnosis, or treatment. Always consult with a healthcare provider before starting any new exercise program, especially if you have pre-existing health conditions, injuries, or concerns.

You acknowledge that physical exercise can be strenuous and may result in injury, including but not limited to muscle strains, sprains, fractures, cardiovascular events, or other serious health complications. You voluntarily assume all risks associated with your use of Gym Clock and any exercises or workouts performed based on or in connection with this Application.

We are not responsible for any injuries, damages, or health issues that may arise from your use of this Application. You are solely responsible for ensuring that any exercise or fitness activities you engage in are appropriate for your physical condition and health status.

3. Calorie & Fitness Data Estimates

All calorie counts, rep counts, fitness metrics, workout recommendations, and related data provided by Gym Clock are estimates based on general formulas, algorithms, and statistical averages. These estimates may not be accurate for your specific body composition, metabolism, fitness level, exercise intensity, or individual circumstances.

Actual calorie burn, fitness metrics, and performance outcomes may vary significantly from the estimates provided by the Application. Factors such as age, weight, height, body composition, fitness level, exercise form, environmental conditions, and individual metabolic differences can all affect actual results.

We make no guarantees, representations, or warranties about the accuracy, reliability, completeness, or suitability of any calculations, estimates, or data provided by the Application. These figures are for informational and entertainment purposes only and should not be used as the sole basis for dietary, medical, or fitness decisions.

4. Privacy & Data Collection

Your privacy is important to us. Please read our Privacy Policy for full details. Summary:

Without an account

  • Workout history, alarms, medals, and most fitness data stay on your device
  • Camera is used only for on-device pose detection; no video is recorded or uploaded
  • We do not collect personal information on our servers for offline-only use

With an optional Gym Clock Account

  • We store account information (email, username, display name, sign-in credentials, or linked Google or Apple sign-in)
  • The App may sync your cumulative lifetime rep total to our servers
  • Your username, display name, and rep total may appear on the leaderboard and in community features (e.g. Locker forum)
  • Your email is not displayed publicly on the leaderboard
  • We do not sell your personal information

5. Permissions & Device Access

Permissions in this section apply whether or not you have an account.

Gym Clock Inc. requires certain permissions to function properly. By using the Application, you grant the following permissions:

  • Camera: Used for real-time pose detection and rep counting. No recording or storage occurs. The camera feed is processed in real-time and immediately discarded.
  • Notifications: Required to alert you when workout alarms are triggered. You can manage notification settings through your device settings.
  • Alarm/Critical Alerts (iOS): Allows alarms to play even when your device is in silent mode, ensuring you never miss a workout. This is essential for the Application's core functionality.

You may revoke any of these permissions at any time through your device settings, though doing so may limit or disable certain features of the Application.

6. User Responsibilities

You are responsible for:

  • Using the Application in a safe and appropriate manner
  • Ensuring you have adequate space and proper equipment for any exercises you perform
  • Not using the Application while operating vehicles, machinery, or in any situation where distraction could cause harm
  • Maintaining the security of your device and any accounts associated with the Application
  • Complying with all applicable laws and regulations in your jurisdiction
  • Not attempting to reverse engineer, decompile, or disassemble the Application

If you create a Gym Clock Account, you are also responsible for:

  • Providing accurate account information
  • Keeping your password confidential and notifying us of unauthorized access
  • Choosing a username and display name that comply with our rules and are appropriate for public display
  • Activity conducted through your account
  • Complying with community rules when using forum or social features linked to your account

7. Gym Clock Account & Online Features

A Gym Clock Account is not required to use core offline App features. An account enables optional online features such as cross-device sign-in, rep-total sync, leaderboard participation, and access to Gym Clock web/community properties (including Locker).

7.1 Account registration

You must provide a valid email address and choose a username and display name. You may register with email and password or, where available, Google or Apple sign-in. You represent that you are legally permitted to create an account in your jurisdiction.

7.2 Public profile information

Your username and display name are public and may be shown on the leaderboard, in community/forum features, and elsewhere in Gym Clock services. You acknowledge this before completing registration. Your email address is not publicly displayed on the leaderboard.

7.3 Username and display name rules

Usernames must follow our format rules (3–30 characters; lowercase letters, numbers, underscores, and hyphens) and must not violate our moderation policies. We may reject, require changes to, or remove usernames or display names that are offensive, misleading, impersonating, reserved, or otherwise inappropriate. Username and display name changes may be limited by a cooldown period.

7.4 Leaderboard

If you use leaderboard features while signed in, your username, display name, and cumulative rep total may be visible to other signed-in users. Rankings are based on server-synced totals. The leaderboard may include synthetic or demonstration entries that are not real users, as disclosed in our Privacy Policy.

Rep totals sync from the App as a single lifetime total. Server totals only increase; local device resets will not reduce your synced total.

7.5 Account security

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us promptly at team@gymclock.app if you believe your account has been compromised.

7.6 Deactivation and reactivation

You may deactivate your account at any time. Deactivated accounts cannot sign in, are removed from the leaderboard, and may be reactivated by signing in again through our reactivation flow. Deactivation does not necessarily delete all data; see our Privacy Policy for retention and deletion requests.

7.7 Prohibited conduct (accounts & online features)

You agree not to:

  • Create accounts using false information or on behalf of others without authorization
  • Attempt to manipulate leaderboard rankings through fraudulent syncing or automation
  • Harass, impersonate, or abuse other users through account-linked features
  • Circumvent security, rate limits, or access controls on Gym Clock services
  • Scrape or bulk-harvest leaderboard or account data

We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

The Application, including all content, features, functionality, design, graphics, user interface, code, and related materials, is owned by Gym Clock Inc. and is protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Application for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Application without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN ONTARIO, CANADA, GYM CLOCK INC. AND ITS DEVELOPERS, OWNERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS (COLLECTIVELY, "GYM CLOCK PARTIES") SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenues, data, use, goodwill, or other intangible losses
  • Personal injury, death, or property damage
  • Any injuries, damages, or health issues arising from your use of the Application
  • Your use or inability to use the Application
  • Any errors, bugs, malfunctions, or technical issues in the Application
  • Any inaccuracy in fitness data, calorie estimates, or other metrics provided by the Application
  • Any unauthorized access to or use of your device or data
  • Any interruption, cessation, or termination of the Application
  • Any loss or corruption of data

The Application is a self-service tool provided "as is" without any warranties or guarantees. You use the Application entirely at your own risk. We assume no responsibility or liability for any consequences resulting from your use of the Application.

For account and online features, this limitation applies to the same extent permitted by law, including interruptions to sign-in, sync, or leaderboard services.

Some jurisdictions do not allow the exclusion or limitation of certain damages or liability for personal injury or death caused by negligence. In such cases, our liability will be limited to the maximum extent permitted by law, but we expressly disclaim all liability to the fullest extent possible under applicable law.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Application will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that the Application will meet your requirements or that the results obtained from using the Application will be accurate or reliable.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gym Clock Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Application; (b) your account activity and use of online features; (c) your violation of these Terms; (d) your violation of any third-party rights, including privacy or intellectual property rights; or (e) any injuries or damages resulting from your use of the Application.

12. Termination

App use: We may terminate or suspend access to the App at any time for breach of these Terms.

Accounts: We may suspend or terminate your Gym Clock Account, with or without notice, for violation of these Terms, abuse of online features, or conduct harmful to Gym Clock or other users. You may stop using the App by uninstalling it. You may deactivate your account separately without uninstalling the App.

Upon termination, your right to use the Application will immediately cease, and you must delete all copies of the Application from your devices.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts of Windsor, Ontario, Canada.

If you are located outside of Canada, you are responsible for compliance with local laws to the extent that local laws are applicable.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page or through other reasonable means. Your continued use of the Application after any changes constitutes your acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Application and uninstall it from your device.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely approximates the intent of the original provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gym Clock Inc. regarding the use of the Application and supersede all prior or contemporaneous communications, proposals, and agreements between you and Gym Clock Inc.

If there is a conflict between general App terms and account-specific terms in Section 7, the account-specific terms govern your use of account and online features.
